Florida Contractors can appeal decisions of the Board
A licensed contractor in the State of Florida who faces discipline from the Construction Industry Licensing Board (CILB) can appeal the decision of the Board and may be able to continue to practice contracting while the appellate court hears the case. For some contractors, when the CILB disciplines their license, such as a probation, suspension, or revocation, the basis for the discipline by the CILB was a factual or legal error during the Board hearing. Once a final order has been issued by the Board via the Department an appeal can commence. Pending the appeal, a stay of the final order can be filed. The appellate court must grant the motion for stay but if the stay is granted then the contractor can continue working pending the decision of the appeals court.
